1. Acceptance of Terms

By accessing and using the website nexximo.com (hereinafter "the Platform"), operated by Nexximo SpA (Tax ID 77.543.210-K, hereinafter "Nexximo"), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, we ask that you do not use our Platform.

2. Description of Service

Nexximo is a real estate crowdlending platform that allows users to explore information about collective investments in construction and urban development projects in Chile. Through the Platform, we provide educational and contact information about real estate investment opportunities.

3. Informational Nature

The information presented on the Platform is informational and educational about real estate crowdlending. It does not constitute financial, legal, or investment advice. Before making any investment decision, we recommend consulting with independent financial and legal advisors.

4. Registration and Use of the Contact Form

When completing the contact form on our Platform, you agree to: (a) Provide truthful, accurate, and up-to-date information. (b) Not use the form to send illegal, offensive, defamatory content or content that infringes third-party rights. (c) Not use automated systems to submit multiple forms.

5. Investment Risks

Investments in real estate crowdlending carry inherent risks, including but not limited to: (a) Risk of partial or total loss of invested capital. (b) Illiquidity risk, as investments may not be easily convertible to cash. (c) Risks associated with the Chilean real estate market, such as price fluctuations and changes in demand. (d) Regulatory risks arising from changes in Chilean legislation. Nexximo does not guarantee returns or recovery of invested capital.

6. Intellectual Property

All content on the Platform, including texts, images, logos, designs, source code, and structure, is the property of Nexximo SpA or its licensors and is protected by Chilean intellectual property laws and international treaties. Reproduction, distribution, or modification of content without express authorization from Nexximo is prohibited.

7. User Obligations

When using the Platform, you agree to: (a) Use the Platform lawfully and in accordance with these Terms. (b) Not attempt to access restricted areas of the system. (c) Not perform actions that could damage, overload, or impair the Platform's operation. (d) Respect the intellectual property rights of Nexximo and third parties.

8. Limitation of Liability

Nexximo shall not be liable for: (a) Direct, indirect, incidental, or consequential damages resulting from the use or inability to use the Platform. (b) The accuracy, completeness, or timeliness of information published on the Platform. (c) Financial losses derived from investment decisions based on information available on the Platform. (d) Temporary service interruptions due to technical maintenance or force majeure.

9. Applicable Law and Jurisdiction

These Terms and Conditions are governed by the laws of the Republic of Chile. Any dispute arising from the use of the Platform shall be submitted to the jurisdiction of the ordinary courts of Santiago de Chile, with the parties waiving any other jurisdiction that may correspond to them.

10. Dispute Resolution

The parties will attempt to resolve any dispute in good faith through direct negotiation. If an agreement is not reached within 30 days, the parties may resort to mediation before a mediator registered with the Chilean Ministry of Justice before initiating legal proceedings.

11. Amendments

Nexximo reserves the right to modify these Terms and Conditions at any time. Modifications will take effect from their publication on the Platform. Continued use of the Platform after the publication of modifications constitutes acceptance of the new terms.
